The following Terms and Conditions apply to the use of this Web site as well as all transactions conducted through the site. The Terms and Conditions constitute the entire agreement between you and Volair Sim with respect to this Web site. The Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Volair Sim with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Volair Sim. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.

 

Consumer Agreement

You may purchase merchandise from this Web site by using any one of the payment options listed. All orders must have identical Ship To and Bill To information including name, address, and phone number. Orders will different Ship To and Bill To information are subject to verification by Volair Sim. If Volair Sim cannot verify an order with different Ship To and Bill To address, such order will not be processed. Volair Sim reserves the right to change its payment procedures at any time without prior notice to you.

Cancelled Orders

Orders that are placed and paid-for and subsequently cancelled by the customer prior to shipping due to reasons outside of Volair Sim’s control and responsibility will be refunded less 3% transaction fee. Orders that have been shipped cannot be cancelled and must be returned via process defined in Return Policy.

PayPal Orders

All orders are subject to verification by PayPal. Billing address and shipping address must be the same. Volair Sim will not ship to PO Box, APO/FPO address. The addresses must be confirmed by PayPal prior to shipment.

Return Policy

RMA for new and unopened packages will be accepted within 10 days from receipt of product by customer subject to 15% restocking fee.  Return shipping costs are responsibility of customer and shipping charges are non-refundable.  

In order to return product, customer must contact Volair Sim by sending e-mail to support@volairsim.com within 10 days of receipt of product and obtain an RMA number. Opened packages, tampered packages, or boxes in non sellable non-presentable condition will not be accepted and will be refused to customer with no refund and return shipping costs paid by the customer.

Shipping & Delivery

Volair Sim uses UPS (“Shipper”) as the default shipping provider. Signature Proof of Delivery is required for all orders and returns. New and unopened merchandise that is refused and are returned to Volair Sim due to incorrect or incomplete shipping address will be refunded less 15% restocking fee. Shipping costs are not refundable. Volair Sim is not responsible for damage caused by Shipper.

At this time, Volair Sim ships merchandise to locations within the United States and U.S. territories and selected international locations (subject to US export restrictions and UPS policies). The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

International

Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

Volair Sim is not responsible for any duties and taxes for orders outside of the United States which are the responsibility of the customer and will be paid by the customer at the time of delivery to the Shipper.

Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. Volair Sim is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

Sales Tax

Volair Sim charges sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being shipped.

Warranties

Volair Sim warrants its products to be free from defects in materials in workmanship for one (1) year from date of purchase to the original customer. The warranty is not transferrable. Defects caused by exceeding cockpit weight limitations or improper usage will not be covered. Wear and tear on upholstered and padded surfaces is not covered. The warranty applies to usage of cockpit in a residential environment. Commercial use is not approved and not covered by warranty policy.

Any missing/damaged hardware must be reported to Volair Sim by sending e-mail to support@volairsim.com within ten (10) days of receipt of product. Requests made after 10 days from receipt of product will not be honored.

Minor scratches/dents, imperfections are not subject to warranty or RMA policy.
